FOIP (Alberta) + Education Act

Alberta school authorities are public bodies under the Freedom of Information and Protection of Privacy Act (FOIP). Student records also fall under the Student Record Regulation.

Notification window

FOIP s.34.1 requires notice to the Office of the Information and Privacy Commissioner (OIPC) where a reasonable person would consider there is a real risk of significant harm. Affected individuals must be notified as soon as practicable.

Unique gotchas

  • Catholic / Francophone separate school divisions have parallel reporting to their authorizing bodies.
  • Charter schools follow FOIP but answer to Alberta Education directly, not a board.
